Welcome to Gleans ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Gleans platform, website (gleans.io), and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Gleans is a revenue intelligence platform for short-term rental properties. The Service analyses market demand, local events, competitor pricing, and other data to generate nightly rate recommendations and, where supported and enabled through available integrations, apply those recommendations to connected listings.
Gleans provides pricing automation and intelligence tools. It does not guarantee any specific level of revenue, occupancy, or financial outcome. Pricing decisions are influenced by numerous external factors beyond our control, and you acknowledge that results will vary. You remain solely responsible for the rates applied to your listings at all times.
To use the Service you must be at least 18 years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us immediately at support@gleans.io if you become aware of any unauthorised use of your account.
Gleans offers the following subscription plans (prices may be updated with notice as described in Section 14):
Standard: $13 per listing per month (or $11 per listing per month when billed yearly).
Multi-unit: $18 per parent listing per month plus $5 per child unit per month.
Enterprise: Custom pricing, available upon request.
New users may be eligible for a guided trial of up to 12 days. No payment card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the guided trial offer at any time.
Subscriptions are billed in advance on a monthly or yearly basis, depending on the plan selected. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You authorise us to charge the payment method on file for all applicable fees.
You may cancel your subscription at any time through your account settings or by contacting support@gleans.io. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then. We do not provide pro-rata refunds for partial billing periods unless required by applicable law.
We may change our subscription fees from time to time. We will provide you with at least 30 days' advance written notice (via email or in-app notification) before any price change takes effect. Your continued use of the Service after the new price takes effect constitutes your acceptance of the updated fees.
You agree not to:
(a) Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
(b) Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service.
(c) Scrape, crawl, or use automated means to access the Service other than through the interfaces we provide.
(d) Share your account credentials with third parties or allow multiple individuals to use a single account.
(e) Intentionally interfere with or disrupt the integrity or performance of the Service.
(f) Use the Service to engage in price-fixing, market manipulation, or any anti-competitive conduct.
The Service may integrate with third-party platforms including, but not limited to, Airbnb, Vrbo, Booking.com, Guesty, Hostaway, and Lodgify ("Third-Party Services"). These integrations are provided for your convenience and are subject to the respective terms and policies of those Third-Party Services.
We are not responsible for the availability, accuracy, or conduct of any Third-Party Service. Changes to third-party APIs, terms, or availability may affect the functionality of the Service, and we shall not be liable for any disruption or loss caused by such changes.
Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in the Privacy Policy.
You retain ownership of all data you provide to the Service ("Your Data"), including listing information, pricing rules, and booking data. You grant us a non-exclusive, worldwide, royalty-free licence to use, process, and store Your Data solely for the purpose of providing and improving the Service.
Upon cancellation of your account, you may request an export of Your Data within 30 days. After 30 days, we reserve the right to permanently delete Your Data from our systems, except where retention is required by law.
The Service, including its software, algorithms, user interface, design, documentation, and all related intellectual property, is and remains the exclusive property of Gleans. Nothing in these Terms transfers any ownership rights to you.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose during the term of your subscription. This licence does not include the right to sublicence, modify, or create derivative works of any part of the Service.
THIS IS AN IMPORTANT SECTION. PLEASE READ IT CAREFULLY.
Gleans provides nightly rate recommendations and, where supported and enabled through available integrations, applies those recommendations to connected listings. These recommendations are generated by algorithms that analyse available market data, and they are not infallible.
You acknowledge and agree that:
(a) Gleans does not guarantee any specific financial outcome, revenue level, or occupancy rate.
(b) Market conditions, guest behaviour, platform policies, and numerous other factors outside our control affect pricing outcomes.
(c) You are solely responsible for reviewing, approving, and overriding any rate applied to your listings. The "override" feature exists for this purpose.
(d) Gleans is a tool, not a financial adviser, revenue manager, or fiduciary. No information provided by the Service constitutes financial advice.
(e) Historical performance data, projections, and estimates shown in the Service are illustrative and do not guarantee future results.
We will use commercially reasonable efforts to make the Service available on a continuous basis. However, we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, unscheduled outages, force majeure events, or circumstances beyond our reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Gleans in the 12 months immediately preceding the event giving rise to the claim.
(b) In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of bookings, loss of data, or loss of business opportunity, whether based in contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Gleans, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) the rates or pricing decisions applied to your listings through the Service.
You may cancel your subscription at any time as described in Section 3.4. Access continues until the end of your current billing period.
We may suspend or terminate your access to the Service immediately and without prior notice if: (a) you breach any material provision of these Terms; (b) your account is overdue for payment beyond a 14-day grace period; (c) we are required to do so by law; or (d) we reasonably believe your use of the Service poses a risk to other users, third parties, or our systems.
Upon termination: (a) your licence to use the Service is immediately revoked; (b) you may request an export of Your Data within 30 days; (c) after 30 days, we may permanently delete Your Data. Sections 7, 8, 10, 11, and 14 survive termination.
These Terms are governed by and construed in accordance with the laws of England and Wales. In the event of any dispute, you agree to first attempt to resolve it informally by contacting us at support@gleans.io. If not resolved within 30 days, either party may bring proceedings in the courts of England and Wales, which shall have exclusive jurisdiction.
We may update these Terms from time to time. We will notify you of any material changes by email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gleans regarding the Service.
Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
Waiver: Our failure to enforce any right shall not constitute a waiver of that right.
Assignment: You may not assign these Terms without our prior written consent. We may assign without restriction.
